According to Judith Levin, The Code of Hammurabi was discovered in the winter of 1902 and 1903 while digging up the site of ancient city of Susa, present day Iran. They found three large shiny pieces of shiny black stone that formed a monument almost seven and a half feet tall (13). The writing was in the script of cuneiform. In essence The Code of Hammurabi was the first set of laws ever established. It was an ‘eye for an eye, tooth for a tooth’ kind of laws. You killed someone†¦someone will kill you. Hammurabi was king of Babylon about 4,000 years ago. Babylon was the land between the rivers, the rivers being Tigris and the Euphrates. He proclaimed that he was â€Å"Hammurabi, King of Justice. † That he protected the weak – poor people, widows, orphans- from the powerful (Levin). I chose to compare some of the law codes in Hammurabi’s Law Codes and some amendments from the United States Constitution. The Code of Hammurabi was believed to be written 1727 BCE (Constitutuion. org). The United States Constitution was ratified 1788. The Code of Hammurabi being one of the first written laws and regulations to the laws and regulations we live by today. I found interesting because knowing where we first started shows how much the human race has changed. When it comes to the characteristics the United States Constitution and Hammurabi’s Law Code have in common both, obviously, are sets of laws. This means that they both have decrees that must be followed. Also, the purpose of both of these laws is to protect and bring justice to the people to whom the rules shall apply. Some basic differences are the severity of rules and punishments. The Code of Hammurabi is kind of extreme. The Code of Hammurabi was a primitive and cruel justice system that relied on fear to keep the populace in line. Hammurabi claimed he was sent by a god to rule, so therefore, no one would question his authority. Religion alone was not enough to keep the people in line, so Hammurabi created a code of laws that would scare the people into obedience. Breaking the laws resulted in an inhumane or exaggerated punishment. Common human error was treated as a crime, and could have severe consequences. The people lived in constant fear of the law. The justice system claimed to have an â€Å"eye for an eye† mentality, but it often seemed that it was a life for an eye. Killing a man for committing robbery is extreme; he could just be picking a pocket, rather than robbing a bank. Cutting of an offender’s hand was a common punishment for small crimes. If a son strikes his father, his hand shall be cut off. This is done regardless of the circumstances, considering the father could be beating the son. Amputating a hand often led to death, for there was no medicine to stop the bleeding. The court attempted to keep people from bearing false witness, by giving severe penalties. If a man cannot prove that the man he is accusing of murder is guilty, he shall be put to death. While this might deter citizens from making false accusations, it might cause an innocent man to be put to death because he could not find evidence. If someone were to bear false witness concerning grain or money, he shall put death. A little extreme, considering it could be concerning pocket change. Sentences like this would cause the people to be afraid to stand up for their rights in court. Severe penalties were often inflicted in cases of common human error. If a physician were to cause a man’s death while operating, he would lose his hand. Physicians who try to do well are punished for making mistakes. Once they lose their hand, they cannot operate again. A bit harsh in my opinion. On the other hand, the United States Constitution isn’t as extreme. It’s not perfect, but nothing really. There is always going to be flaws. The United States Constitution covers all the almost all the laws as the code of Hammurabi, but not so extreme. With the Law of Hammurabi, only one person could decide the person’s fate. With the Constitution, we the people have the right to have someone defend us in court. We have the right to be tried by a grand jury versus the judge himself/herself. We have many more options to protect ourselves. We have rights that follow us all through the process. For example, once we get arrested we have our Miranda rights; we have a time limit as to how long they can keep us under custody. For example, once arrested, if we don’t see a judge with a certain amount of hours they have to let us go. With the code of Hammurabi, you stood trial. If one person and one person only believed you were guilty, then not even God would save you. If the judge couldn’t determine who was the guilty and who the innocent was, you had to do some extreme things that were totally uncalled for. For example, â€Å"if any one bring an accusation against a man, and the accused go to the river and leap into the river, if he sink in the river his accuser shall take possession of his house. But if the river prove that the accused is not guilty, and he escape unhurt, then he who had brought the accusation shall be put to death, while he who leaped into the river shall take possession of the house that had belonged to his accuser (King). Something interesting about both of them is their regulations for people who tell lies against other people. Under Hammurabi’s rule if someone came forward to accuse someone else of a crime, they better have the means of evidence to back it up or there would be consequences. For example, if I came forward and accused Ben of stealing, if I can’t prove Ben was stealing then my punishment for lying would be the punishment Ben would have gotten if he really was stealing. Under the Code of Hammurabi this is getting my hand cute off (Legal History and Philosophy). So people were pretty spectical about coming forward and accusing people with crimes if they didn’t have rock hard evidence. Under the United States Constitution, there is a charge and penatly for lying or give the police unreliable information and it conflicts with an investigation. If it might give us a misdemeanor but nothing major like cutting off someone’s hand. Hammurabi’s Code was stricter and less tolerant. The United states Constitution is strict but it has its parameters. It doesn’t just go off on a killing spree for everyone crime in the book. The Code of Hammurabi, most of the consequences for the crimes is death. That’s kind of harsh. Everyone under Hammurabi’s reign became model citizens, expert liars, or were extinct with the rest of the population he was killing. People were afraid to do anything. He called himself the defender of middle class and the poor but in reality he didn’t protect them. He fined the rich because they had the money to pay, if they got caught up in a crime all they had to to do was pay. When the poor got involved with crimes they didn’t have money to pay up so they were punished with other means†¦like cutting of f a hand, being put to death, etc. It is good that someone did establish laws starting with â€Å"if. † Instead of having something is just illegal or â€Å"thou shall not†¦Ã¢â‚¬â„¢ The Hammurabi Code’s were actually set realistically. The descriptions that Crane uses in the opening scenes illustrate natures lack of concern for their tragedy. He discusses the waves in the ocean that continually roll and crest. The waves are problems or situations that are unavoidable; moreover, the waves continue to flow one after another towards the poor rowers. Also, the birds sat comfortably in groups, and they were envied by some in the dingey because the birds were indifferent towards the sailors situation. They were sitting happily as if nothing was going on around them. The sailors were envious of this because they were forced to confront natures trials. The sun continues to rise and set daily, maintaining this routine regardless of what occurs in the world. The shore is also lonely and indifferent. This indifference causes the men to feel a certain isolation from nature. The men feel as if fate (the seven mad gods) controls their destinies. Their thoughts are given: If I am going to be drownedwhy, in the name of the seven mad gods who rule the seaIf this old ninny-woman, Fate, cannot do better than this However, the men realize that there is no fate and that there is no purpose for where they are. There is also a shark that is playing around near the boat; curiously, it does not seem to even acknowledge their presence. The realization that they have no purpose brings them to the brink of despair. In the beginning of the story, the author describes the dawn of seven turned faces. These are faces of the seven mad gods who are apathetic towards the men; moreover, they are part of nature. Towards the end of the story, the correspondent recalls a childhood verse that helps him to understand natures indifference. Through their experience together, the four men realize that all they have is each other. The correspondent feels sympathy suddenly for a dying soldier, one who does not even exist, The correspondent, dreamingwas moved by a profound and perfectly impersonal comprehension. He was sorry for the soldier of the Legion who lay dying in Algiers. Being in the current situation, the correspondent finally understands the tragedy of the dying soldier. He realizes what it is like to be alone in a cruel world and more importantly, he realizes he does not have to be alone. When he first heard the story, he was also indifferent towards the soldier, just as nature is indifferent towards the rest of the world. He now understands what it is to be human. This is a page turner with complex characters and situations that will make you think hard about friendship, good and evil, betrayal, and redemption. It is intense and contains some graphic scenes; however, it is not gratuitous. A great book by many measures. Reading The Kite Runner by Khaled Hosseini On one level, The Kite Runner by Khaled Hosseini is the story of two boys in Afghanistan and Afghan immigrants in America. It is a story set in a culture that has become of increasing interest to Americans since the September 11, 2001, attacks. It also explores the history of the rise of the Taliban in Afghanistan. On this level, it provides a good way for people to learn more about Afghan history and culture in the context of the story. Looking at The Kite Runner as a story about culture, however, misses what the book is really about. This is a novel about humanity. This is a story about friendship, loyalty, cruelty, longing for acceptance, redemption, and survival. The core story could be set in any culture because it deals with issues that are universal. The Kite Runner looks at how the main character, Amir, deals with a secret in his past and how that secret shaped who he became. It tells of Amirs childhood friendship with Hassan, his relationship with his father and growing up in a privileged place in society. I was drawn in by Amirs voice. I sympathized with him, cheered for him and felt angry with him at different points. Similarly, I became attached to Hassan and his father. The characters became real to me, and it was difficult for me to put the book down and leave their world. I highly recommend this book, especially for book clubs. For those of you who are not in a reading group, read it and then loan it to a friend. You are going to want to talk about it when you finish.

She has type 2 diabetes mellitus, a right-sided chronic lower leg ulcer and arthritis affecting both knees. Her glucose levels are high because of her nutritionally poor diet. After consultation with the required health professional team she was advised about healthy eating that was culturally and religiously appropriate. Her wound was managed with guidance from the tissue viability nurse and her pain level was assessed and addressed. This assignment will provide a reflective appraisal of the preparation and delivery of the oral presentation mentioned above. When commencing a reflective learning task it is important to understand the concept of reflection and the values of the reflective process, especially pertaining to nursing practice. There are many varied and valid interpretations of reflective learning; however, it is suggested that reflection is the contemplation of an event or activity that leads to professional knowledge enhancement and if needed, purposeful change to practice (Wilkinson, 1999, p36). It can be said that one of the main values of reflective learning is that it can bridge the perceived gap between theory and practice by informing and extending students thinking in classroom and clinical situations. One of the key strengths of this presentation was the preparation undertaken before designing it using PowerPoint. However, this was extremely time consuming, but I felt that having a plan of action was imperative to success. Preparing for the presentation included research into how effective presentations are planned and an action plan of the material that I wanted to use. Although there was a lot of material that could have been used in the presentation, I decided to use the most relevant information to get my message across. The presentation was ten minutes in length and there was only enough time to convey the main, relevant points. Having said this, keeping the presentation simple and interesting would have helped to capture the audiences’ attention. The main points to be conveyed were placed on PowerPoint as this gave the presentation a more professional impression. It is important to note however that the use of visual aids such as PowerPoint slides should aid the presentation and not distract from it (Hadfield-Law, 2001, p1210). The structure of the presentation included an introduction, the main text of the talk and a conclusion. The introduction attempted to communicate to the audience a profile of the patient and the care needed. The conclusion was expressed in a way that clearly conveyed the message that I wanted to get across. Another major strength of this presentation was that of time management both in the preparation and delivery of the presentation. I managed to undertake the presentation within the allotted time period. This is imperative as people expect you to keep to your allotted time. If you overrun there is a possibility of people becoming restless and consequently not concentrating on what is being said. Going over the time limit also shows poor preparation, planning and rehearsal. I found delivering the presentation immensely stressful and my anxiety levels were extremely elevated. I felt that control of my anxiety could be worked on for future presentations. However, I consider that one of my main strengths when delivering this presentation was that I felt that my body language conveyed professionalism and knowledge of subject. Writing this reflective commentary on my oral presentation has been difficult because of a number of factors. The lack of feedback has meant that I can only relay my views on how the presentation was received and not the views of the audience. Having reflected on the content of my presentation I wondered if I focussed on the patient enough, as her clinical care, personal, psychological and social needs were the focal point of this presentation. I felt that I excessively discussed the involvement of other the health professionals, clinical symptoms and clinical care given, thereby demonstrating the holistic nature of the care undertaken to the detriment of discussing my patients needs more fully. Again, feedback on my presentation would have enabled me to assess and critically analyse this point. The main learning outcome of this assignment was the realisation of the importance of health professionals working together as a team for the benefit of the patient. Secondly, I acknowledged the effect of giving proper advice on guiding the patient to care for herself. Thirdly, I understood the significance of using appropriate language in communicating with the patient to promote understanding of the situation. Fourthly, I realised the importance of family involvement in the patient’s care. The learning outcomes of the presentation were that of the importance of preparation, planning and rehearsing in order to achieve success and to help reduce stress and anxiety. Reflective learning is a useful skill to develop in a work setting and has potential benefits in the planning and delivery of clinical care. High-end customers HTC is currently focusing on high-end customers who are tech savvy, able and willing to pay for premium mobile phones. These high-end customers are currently up and coming professionals, live a fast moving lifestyle and mostly reside or work in first or second tier cities, such as Beijing, Shanghai and Xi Chuan. All of these customers have subscribed or are going to subscribe 3G network, in order to make the most of out HTC’s smartphones. In addition to product quality and operating system, high-end customers nowadays also care about brand reputation and image. The proposed marketing campaign for HTC’s high-end customers is therefore to enrich the brand experience and differentiate HTC’s personality. Basic customers As mentioned earlier, 3G users accounts to less than 20% of China’s mobile phones market. According to market analysis, local players, best represented by ZTE and Huawei, are more popular amongst price sensitive mass and lower-end customers. These basic customers reside in third tier cities or rural areas, demand basic functions for their phones and also aspires to own a smartphone one day. Product Designers collaborations are nothing new. Indeed, they are now a well-established marketing tool – as well as source of income. Standard Hotel Group in America has joined forces with the likes of surfwear brand Quiksilver to provide exclusive trunks and bikinis that guests can purchase in the group’s resorts. H&M, the Swedish fashion behemoth, took rise after asking Karl Lagerfeld, designer for Chanel and owner of Fendi, to come up with a special collection back in 2004. For mobile phones,it is no different story. RIM collaborated with Porsche design and launched a high-end luxurious blackberry in 2011. LG and Prada started working together in 2006[9] and continued to attract fashionistas for their crossover phones. For high-end customers, HTC should leverage connection with a renowned brand within the Chinese community and produce collaborate products. Nike would deem to be an appropriate choice, given the brand is held in high regards among Chinese and its innovative brand image aligns with that of HTC’s. Nevertheless, Nike has strong connection with Apple as Nike currently produces Nike+ – a tracking device that connects an athletes’ performance data with iPhones, iPods etc. If there is a brand for up-and-coming professionals which matches HTC’s pricing and targeting strategy, Adidas would be a great fit. Rather than choosing a luxury brand such as LVMH or Gucci, a partnership with Adidas could not only appeal to the sports lovers, but also be perceived as socially acceptable. Partnering with luxurious goods might risk further alienation as the wealth gap widens in China. Adidas is actively investing on its mi adidas platform that rivals Nike+. The sports company enjoys a good reputation in China after sponsoring Team China in Beijing Olympics, and its innovative roots in products and designs could enrich the HTC brand experience. For basic customers, HTC could build 2G or even very basic 3G phones to attract the mass. With much reduced functionality and a lower price point, HTC could attract the 80% users who have not yet subscribe to 3G network. While the simpler handsets should have less fancy functions, embodying the HTC names mean that that the phones should still be innovative. HTC could be more localize with these phones by having local functions such as Chinese keyboard and improved durability that adapts to environment in rural areas. Perhaps basic phones could have a brighter screen for users to view the screen easily in open rural areas, or made in anti-sand materials as desertification is common in northwest China. Aside from hardware reengineering, HTC needs to redesign its software capabilities. HTC is relatively weak in content when compared to rivals such as Apple. It has no plans to launch its own app store, preferring instead to reply on Android marketplace and its apps. HTC acquired French content provider Abaxia in June 2010[10] to develop innovative apps for its devices. Recently, it has installed digital map apps in HTC Sense interface. Currently, there is a market gap in smartphone manufacturer originated apps in China. Almost all of the apps available on Android/iPhone system are developed by individual software company. HTC could potentially develop operating system with apps linked to popular Chinese social media sites, such as QQ and Sina’s Microblog. Price HTC should continue to target upper tier price points for its high end customers. Its currently price point closely resembles Apple’s and Samsung’s, averaging around RMB2,500 (US$400). The high price setting strategy further illustrates HTC’s ambition to compete with the international brands but the company could consider undercutting its price by a fraction, say less than 10%, than the leaders so as to gain stronger market share. Price reduction should not be advertised aggressively, as it might signal a loss in quality. For products in the lower end market, HTC should try to be a price leader in the arena. Lenovo markets its cheaper line of phones around RMB700, and HTC should try to undercut Lenovo. It is important to capture the basic customers first, with the hope that HTC could persuade basic users to switch to more expensive phones over time. Place According to Economists, HTC now as 2,300 authorized retailers in China. Apple has 3,500 – not withstanding its flagship Apple store and website – while Nokia and Samsung have 9,000 each. HTC could open more shops by granting authorized retailers license, but it is easier said than done as brands jostle retailers for shelf spaces. Rather than investing heavily in opening its own shop, HTC could form a strategic partnership with popular online shop Taobao or Alibaba to reach customers in the second or third tier cities to compliment its e-shop. Further place promotion could been referred in ‘HTC ambassador’ campaign in People section. In first tier cities, HTC could theoretically leverage on Adidas’s store presence and distribution network. Nonetheless, HTC should adopt a selective approach by opening flagship store that can illustrates its customer experience. Promotion In HTC’s incumbent global marketing campaign, the company slogan is ‘quietly brilliant’. HTC commercials do not focus on the precise functionality of their handsets but the way people use them. The concept itself is intuitive, but the campaign is not as much advertised in China as other places – the slogan does not even has a Chinese translation. As a result, HTC’s promotion in China is product focused. HTC One X advertisements were filmed where a photographer takes pictures with HTC phone while skydiving – stressing the superior camera quality of the handset. To revamp the promotion campaign, HTC should first come up with a better slogan for China or even for its global campaign. Stressing on the way people interact with HTC cell phones is a good idea, but conceptually the slogan could be more straight forward – Nokia’s ‘connecting people’ or LG’s ‘life is good’ are good examples. For China specifically, HTC needs to build on build on enriching users experience. Yan Siqing, chief operating officer of China Telecom said HTC grew rapidly despite its late start because it provided a â€Å"good user experience†. Nationwide promotion campaign should focuses on how HTC helps people to capture their moments in life. Whether is at work, in sporting moments or vacation, a user-friendly HTC handset is always there to make things happen. People Simliar to Unilever’s â€Å"Shakti Revolution† to help women in rural India to become entrepreneurs[11], HTC could foster partnership with non governmental organisations, banks and local counties, to promote handsets at rural areas through employing ‘HTC ambassadors’. Ambassadors are underpriviledged residents in country sides and they are invited to become direct-to-consumer sales distributors for HTC’s basic handsets for second or third tier cities. Contrary to normal mom-and-pop shops, HTC should provide training in selling, commercial knowledge and bookkeeping to help ambassadors become micro-entrepreneurs. Question 1 HIV, or Human Immunodeficiency Virus, attacks the human immune system and greatly weakens the body’s ability to fight foreign invaders and infection. HIV first demanded notice in the early 1980s in the United States in homosexual men displaying illnesses like Pneumocystis carinii pneumonia and Kaposi’s sarcoma. The disease was soon observed in IV drug users, hemophiliacs, and blood transfusion recipients, but became publicized as a â€Å"gay disease,† nicknamed by the media as GRID, or Gay-Related Immuno Deficiency. It was later renamed AIDS, or Acquired Immuno Deficiency Syndrome, in September of 1982. Before the true cause of the disease had been discovered, it had killed countless people and received immense press coverage, and the infection rate was rampant, because the cause was unknown and thus no treatment method could be developed. Finally, in 1983, two separate research teams, lead by Robert Gallo and Luc Montagnier of the Pasteur Institute in isolated a retrovirus that was the true infectious agent responsible for the development of AIDS. Gallo’s team named the virus HTLV-III and Montagnier’s team coined it as LAV, or lymphadenopathy-associated virus. Later, it was discovered that the two viruses were exactly the same; it was renamed as Human Immunodeficiency Virus, and Gallo and Montagnier now share the credit its discovery.
